Terms and Conditions for BVE Contracting Ltd t/a Gateway Electrical
1. Introduction
Welcome to BVE Contracting Ltd t/a Gateway Electrical. These terms and conditions outline the rules and regulations for the use of our electrical services.
2. Definitions
“Company” refers to [Gateway Electrical], its employees, and authorized agents.
“Client” refers to any individual or entity that engages the services of the Company.
“Services” refer to all electrical work carried out by the Company, including but not limited to installations, maintenance, repairs, and inspections.
3. Acceptance of Terms
By engaging our services, the Client agrees to be bound by these terms and conditions. The Company reserves the right to modify these terms at any time, and any changes will be communicated to the Client in writing.
4. Services
4.1 Scope of Services:
The Company agrees to perform the services as outlined in the service agreement or quotation provided to the Client. Any additional work or variations to the original scope of services must be agreed upon in writing.
4.2 Quality of Workmanship:
The Company guarantees that all work will be performed in accordance with the relevant New Zealand electrical standards and regulations. The Company will make every effort to ensure that services are delivered on time and within budget.
5. Pricing and Payment
5.1 Quotations:
All quotations provided are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change after this period.
5.2 Payment Terms:
Unless otherwise agreed in writing, payment is due within 7 days of completion of services. The Company accepts payment via bank transfer or cash. Please be advised that hourly rates may increase periodically. This adjustment may be necessary to account for factors such as inflation, increased operational costs, and changes in industry standards or changes in the economic environment. We strive to provide exceptional value and service, and these updates ensure that we can continue to meet your needs with the highest quality of service. You will always be notified of any changes with a 30 day notice of any such increases.
5.3 Deposits and Progress Payments:
A deposit of 30% may be required before work commences. For larger projects, progress payments may be required as outlined in the service agreement.
5.4 Late Payments:
The Company reserves the right to charge interest on overdue payments at a rate of 2% per month. If payment is not received within 14 days of the due date, the Company may suspend or terminate services.
6. Cancellation and Rescheduling
6.1 Cancellation by the Client:
The Client may cancel the services by providing at least 5 business days’ notice. Cancellations made with less notice may incur a cancellation fee of $180 + GST.
6.2 Rescheduling:
The Client may reschedule services by providing at least 3 business days’ notice. The Company will make every effort to accommodate the new schedule.
6.3 Cancellation by the Company:
The Company reserves the right to cancel or reschedule services due to unforeseen circumstances, including but not limited to adverse weather conditions or safety concerns.
7. Client Responsibilities
7.1 Access to Site:
The Client must ensure safe and reasonable access to the site where services are to be performed. The Client is responsible for obtaining any necessary permissions or permits required for the work.
7.2 Provision of Information:
The Client must provide accurate and complete information regarding the site and the scope of work. The Company is not responsible for delays or additional costs resulting from incomplete or inaccurate information.
8. Warranties and Liabilities
8.1 Warranties:
The Company warrants that all services will be performed with reasonable skill and care. This warranty does not cover defects or damages caused by misuse, negligence, or unauthorized modifications by the Client or third parties.
8.2 Limitations of Liability:
To the maximum extent permitted by law, the Company is not liable for any indirect, incidental, or consequential damages arising from the performance of its services. The Company’s total liability for any claim arising from these terms is limited to the amount paid by the Client for the services.
9. Dispute Resolution
Any disputes arising from these terms and conditions will be resolved in good faith through negotiation between the parties. If a resolution cannot be reached, the parties agree to submit the dispute to mediation or arbitration in accordance with the laws of New Zealand.
10. Governing Law
These terms and conditions are governed by the laws of New Zealand. Any legal proceedings arising from these terms will be conducted in the courts of New Zealand.
11. Privacy Policy
The Company respects the Client’s privacy and will handle personal information in accordance with the New Zealand Privacy Act 2020. The Company will not share or sell any personal information without the Client’s consent unless required by law.
12. Health and Safety
The Company is committed to ensuring the health and safety of its employees, clients, and the public. The Client agrees to comply with all relevant health and safety regulations and to notify the Company of any hazards or risks present at the site.
13. Force Majeure
The Company is not liable for any failure to perform its obligations due to circumstances beyond its control, including but not limited to natural disasters, strikes, or acts of government.
